These Terms of Service govern your access to and use of the Jovany Sabilla online storefront and any products or services offered through it.

By visiting the store, submitting information, creating an account, or placing an order, you agree to these Terms of Service and our other posted policies.

Eligibility

You represent that you are legally capable of entering into a binding agreement in your place of residence.

When a person who is not legally able to enter into a contract uses the store, the store must be used under the involvement and supervision of a parent or legal guardian.

Store products

We may offer any lawful products selected for sale through the storefront.

Product descriptions, specifications, photographs, measurements, colors, availability, and prices are provided in good faith. Actual colors or appearance may vary depending on lighting, packaging, manufacturing variations, or device displays.

We may change, discontinue, limit, or update products at any time.

Orders

Submitting an order is an offer to purchase the listed products.

We may accept, reject, limit, or cancel an order for reasons including:

• Product unavailability.
• Incorrect pricing or product information.
• Suspected fraud or unauthorized activity.
• Payment failure.
• Shipping restrictions.
• Errors affecting inventory or fulfillment.
• Suspected resale or commercial misuse.
• Legal or regulatory restrictions.

An automated order confirmation acknowledges receipt of the order but does not necessarily mean the order has been finally accepted.

If we cancel a paid order, we will issue an appropriate refund to the original payment method.

Customer information

You agree to provide current, complete, and accurate billing, shipping, payment, and contact information.

You are responsible for reviewing the shipping address before placing an order and promptly notifying us of any error. We cannot guarantee that an address can be changed after fulfillment begins.

Prices and payments

Prices are displayed in the currency shown at checkout.

Applicable taxes, shipping charges, duties, and other charges will be shown before purchase when they can reasonably be calculated.

You authorize us and our payment processors to charge the payment method submitted for the total amount displayed at checkout.

We may correct pricing, product, or typographical errors. When an error affects an order, we may contact you for instructions or cancel and refund the order.

Promotions and discount codes

Promotions, coupons, discounts, and special offers:

• May be subject to separate conditions.
• May expire or be withdrawn as permitted by law.
• Cannot be redeemed for cash unless required by law.
• May not be combined unless expressly permitted.
• May be limited to one use per customer, account, household, or order.
• May be canceled when obtained through fraud, abuse, or technical error.

Shipping and delivery

Shipping is governed by our Shipping Policy.

Delivery dates are estimates unless we expressly guarantee a particular delivery service in writing. Delays may occur because of carriers, weather, customs, supply interruptions, incorrect addresses, emergencies, or circumstances outside our reasonable control.

Returns and refunds

Returns, exchanges, refunds, and cancellations are governed by our Return and Refund Policy.

Mandatory consumer rights continue to apply regardless of these terms.

Accounts and passwords

When customer accounts are available, you are responsible for maintaining the confidentiality of your login information and for activity performed through your account.

Notify us promptly if you believe an account or password has been compromised.

We may suspend or terminate accounts involved in fraud, abuse, unauthorized activity, or violations of these terms.

Acceptable use

You may not use the store to:

• Commit fraud or misrepresent your identity.
• Infringe intellectual-property, privacy, or other legal rights.
• Transmit malicious software or harmful code.
• Interfere with the security or operation of the store.

• Submit false reviews or misleading content.
• Harass, threaten, abuse, or discriminate against others.
• Place orders using stolen or unauthorized payment information.
• Resell products when the applicable listing expressly prohibits resale.

Intellectual property

Unless otherwise stated, the store’s design, branding, text, photographs, graphics, logos, product descriptions, videos, and other content are owned by or licensed to ALIEL THINK LLC.

You may use the store for personal, lawful shopping purposes. You may not reproduce, modify, distribute, sell, publicly display, or commercially exploit store content without written permission from the applicable owner.

Third-party trademarks belong to their respective owners.

Reviews and submitted content

If you submit a review, photograph, comment, suggestion, or other content, you represent that:

• You have the right to submit it.
• It is truthful and based on genuine experience where represented as a review.
• It does not violate another person’s rights.
• It is not unlawful, fraudulent, defamatory, abusive, or misleading.

You grant ALIEL THINK LLC a nonexclusive, worldwide, royalty-free license to use, reproduce, edit, display, and distribute submitted content for store operation, customer support, and marketing, subject to applicable privacy law.

We may remove content that violates these terms.

Third-party services and links

The store may contain integrations or links provided by Shopify, payment processors, social-media platforms, delivery companies, or other third parties.

We do not control and are not responsible for third-party websites, products, content, terms, availability, or privacy practices.

Disclaimer of warranties

To the fullest extent permitted by law, the store and its content are provided on an “as available” basis.

We do not guarantee that the website will always be uninterrupted, secure, error-free, or compatible with every device.

Products remain subject to any express written warranty provided with the product and to rights that cannot legally be excluded.

Nothing in these terms excludes warranties, guarantees, or remedies that applicable law does not permit us to exclude.

Limitation of liability

To the maximum extent permitted by law, ALIEL THINK LLC and its owners, personnel, contractors, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the store or purchase of a product.

This limitation does not apply where liability cannot legally be limited, including liability arising from fraud, willful misconduct, or other matters protected by mandatory law.

Indemnification

To the extent permitted by law, you agree to indemnify ALIEL THINK LLC against third-party claims, losses, or reasonable expenses resulting from your unlawful use of the store, violation of these terms, or infringement of another person’s rights.

This provision does not require a consumer to indemnify us for our own unlawful conduct.

Suspension and termination

We may restrict or terminate access to the store when reasonably necessary to protect the store, customers, service providers, or legal rights.

Provisions that by their nature should continue after termination will remain effective, including intellectual-property, disclaimer, liability, dispute, and payment provisions.

Governing law

These terms are governed by the laws of the State of Texas and applicable United States federal law, without regard to conflict-of-law principles.

Subject to any mandatory consumer rights, legal proceedings relating to these terms may be brought in a court with jurisdiction in or serving Travis County, Texas.

Nothing in this section deprives a consumer of protections that apply under the mandatory law of the consumer’s place of residence.

Changes to these terms

We may update these Terms of Service by posting a revised version with a new “Last updated” date.

Changes will apply prospectively unless applicable law permits otherwise.
